What Happens to Your CDL After a DUI in Tennessee?

Can You Lose Your CDL for a DUI in Tennessee?

Yes. A DUI conviction can disqualify you from operating a commercial motor vehicle in Tennessee, even if you were arrested while driving your personal car. For a commercial driver, that can mean losing the ability to work long after the criminal court case ends.

A first qualifying DUI conviction generally results in a one-year commercial driving disqualification. A second qualifying major violation from a separate incident can result in a lifetime disqualification. The outcome depends on the offense, your driving history, and whether you were operating a commercial or personal vehicle.

The important distinction is that your criminal DUI case and your commercial driving eligibility are separate issues. Both need attention when your livelihood depends on your CDL.

Does a DUI in Your Personal Vehicle Affect Your CDL?

Yes. Federal commercial driver rules apply to certain serious offenses committed by CDL holders in personal vehicles, including driving under the influence.

For example, a truck driver arrested for DUI while driving home in a personal car can face commercial driving consequences even though no commercial vehicle was involved. The 0.04% alcohol concentration standard specifically concerns operating a commercial motor vehicle, but a qualifying DUI conviction in a personal vehicle can still lead to CDL disqualification.

Being off duty does not automatically protect your commercial driving privileges.

How Long Do You Lose Your CDL After a DUI?

Federal law establishes disqualification periods for major offenses, including qualifying DUI convictions and certain chemical test refusals.

ViolationGeneral CDL consequence
First qualifying DUI conviction in a commercial vehicleOne-year disqualification
First qualifying DUI conviction in a personal vehicleOne-year disqualification
First qualifying violation while transporting hazardous materials in a commercial vehicleThree-year disqualification
Second qualifying major violation from a separate incidentLifetime disqualification

Lifetime disqualification rules have limited reinstatement provisions for certain offenses, subject to applicable law and state procedures. Drivers should not assume that reinstatement will be available or automatic.

Is the CDL Disqualification Different From Losing Your Regular License?

Yes. A commercial driving disqualification prevents you from operating commercial motor vehicles. Revocation or suspension of your ordinary driving privileges is a separate consequence.

For example, a driver might eventually regain the ability to drive a personal car but remain disqualified from operating a commercial truck. Similarly, obtaining restricted driving privileges does not automatically authorize commercial driving.

Before returning to work, confirm your status with the Tennessee Department of Safety and Homeland Security rather than relying only on the outcome of your criminal case.

What Is the BAC Limit for CDL Drivers in Tennessee?

A blood alcohol concentration of 0.04% or greater while operating a commercial motor vehicle is a major violation that can result in CDL disqualification.

That does not mean every person who holds a CDL is subject to the 0.04% standard whenever driving a personal vehicle. Tennessee's ordinary DUI laws still apply to personal driving, and a person can be charged with impairment even when a chemical test does not establish the usual per se BAC threshold.

Commercial drivers also face separate rules concerning alcohol use and safety-sensitive duties. The type of vehicle, circumstances of the stop, and alleged violation all matter.

What Happens After a First DUI With a CDL?

A CDL holder convicted of a first DUI may face both commercial driving disqualification and the penalties associated with the underlying Tennessee DUI conviction.

For a first Tennessee DUI conviction, the general criminal penalties include a minimum of 48 consecutive hours in jail, increasing to seven consecutive days when the BAC is 0.15% or higher. Fines generally range from $350 to $1,500, and a first conviction also carries a one-year ordinary driver's license revocation.

The commercial driving consequences are additional. A driver may be unable to perform a job requiring a CDL even after completing the criminal sentence.

Can You Keep Working While Your DUI Case Is Pending?

A DUI arrest does not necessarily mean a CDL holder is already disqualified. The timing and legal basis of any disqualification must be determined from the driver's circumstances, including whether a qualifying conviction, test refusal, or separate administrative action has occurred.

An employer may also have its own reporting, qualification, and employment policies. Do not assume that a pending criminal case leaves every commercial driving option unaffected.

Can You Get Your CDL Back After a DUI?

After a first qualifying disqualification, reinstatement may be possible once the required period ends and all applicable eligibility and administrative requirements have been satisfied.

A lifetime disqualification is considerably more serious. Federal regulations permit limited reinstatement pathways for certain offenses, but eligibility is not universal and depends on the governing rules and state procedures.

The answer also depends on your prior record. Federal regulations count qualifying major violations from separate incidents, which means a driver should not evaluate a new DUI without reviewing earlier commercial driving offenses.

Can a DUI Be Reduced Without Losing Your CDL?

A reduction of a criminal DUI charge does not automatically resolve every commercial licensing issue. CDL disqualification rules may depend on the qualifying offense, the final disposition, and any separate administrative proceedings.

This is especially important when discussing a potential reduction to reckless driving. A driver needs to understand both the criminal consequences and the commercial licensing consequences before accepting an agreement.

An attorney should examine the traffic stop, video footage, chemical testing, and relevant records while also evaluating how a proposed resolution could affect commercial driving eligibility.

What Should a CDL Holder Do After a DUI Arrest?

Keep the citation, arrest paperwork, chemical testing documents, and any notices concerning your license. Record what happened during the stop while the details are fresh, and pay close attention to court dates and administrative deadlines.

Before pleading guilty, paying a related citation, or accepting a negotiated resolution, make sure you understand the possible CDL consequences. An outcome that appears manageable in criminal court may still have serious employment implications.
