DUI With a Child in the Car in Tennessee: What Happens Next?

A DUI Arrest With a Minor Passenger Can Mean More Jail Time

Being arrested for DUI is serious enough on its own. When a child under 18 is in the vehicle, Tennessee law imposes additional penalties that can make the consequences substantially more severe. A parent driving home with their child, someone transporting a younger sibling, or a driver with another minor passenger may face the same enhancement if convicted.

The most immediate concern is jail time. Tennessee requires an additional 30 days of incarceration for a DUI conviction involving a passenger under 18, even when the child was not injured and no accident occurred. That time is added to the mandatory sentence for the DUI itself, which means a first offense can carry a much longer minimum jail sentence than many people expect.

At Herbert & Lux, we represent clients charged with DUI in Nashville and throughout Middle Tennessee. When a minor passenger is involved, we look closely at the circumstances of the arrest because the added penalties make it especially important to examine the evidence before deciding how to approach the case.

What Are the Penalties for DUI With a Child in the Car?

Under Tennessee Code § 55-10-403, a DUI conviction involving a child passenger carries an additional 30 days in jail and a $1,000 fine. Both are added to the penalties for the underlying DUI conviction.

For a first-offense DUI, the ordinary minimum jail sentence is 48 hours, with a fine ranging from $350 to $1,500. If a child under 18 was in the vehicle, the combined minimum jail sentence becomes 32 days, and the combined fines range from $1,350 to $2,500. A higher blood alcohol concentration can increase the underlying mandatory minimum, and prior DUI convictions can make the overall sentence more severe.

The conviction can also bring driver's license revocation, ignition interlock requirements, court costs, and other obligations. For a parent or caregiver, the practical effects of an extended jail sentence can be especially difficult, affecting employment, childcare, and family responsibilities.

Is DUI With a Child in the Car a Felony?

Not automatically. When a child is present but is not seriously injured or killed, the additional punishment generally applies to the DUI conviction rather than turning it into a felony solely because a minor was in the vehicle.

The situation changes if the child suffers serious bodily injury or dies as a result of the offense. Tennessee law provides for felony charges in those circumstances, with significantly greater potential penalties. The prosecution must still establish the elements of the applicable offense, including any required connection between the alleged impaired driving and the injury.

Can a DUI Arrest With a Child Passenger Affect Your Family?

A criminal charge is not the only concern for some parents. Depending on what happened, an arrest involving a child passenger may prompt questions from child welfare authorities or become an issue in an existing custody case. That possibility can be particularly stressful when the child was unharmed and the driver has never been arrested before.

An arrest does not automatically mean a parent will lose custody or that child welfare authorities will take action. Those decisions depend on the circumstances and any separate proceedings. Still, it is important to understand that statements made during the DUI investigation and the facts recorded in the police report may have consequences beyond the criminal case.

How Herbert & Lux Defends DUI Cases Involving Children

The presence of a child does not relieve prosecutors of their obligation to prove the DUI charge. Whether the arrest began with a traffic violation, a checkpoint, or a reported driving concern, Herbert & Lux examines what led police to stop the vehicle and what evidence supports the allegation of impairment.

That review may involve dashcam and bodycam footage, field sobriety tests, blood or breath testing, and inconsistencies between an officer's report and the available recordings. We also consider the facts supporting the child-passenger enhancement. The defense must be built around the actual evidence, not simply the seriousness of the allegation.

Our attorneys bring different experience to that work. Eddie Herbert previously represented clients in Davidson County General Sessions and Criminal Court through the Public Defender's Office, while Ron Lux has a background in law enforcement. Herbert & Lux has secured DUI dismissals and reductions in cases involving disputed police conduct and testing evidence. Those results are specific to the individual cases, but they reflect the importance of scrutinizing how an arrest was made and whether the evidence supports the charge.
